Attack and Spy bug

The planet 5:204:9 have 3409 points. I have 7622
The diference betwen us is less than 2.4x. So why he can spy and pirate me and i cant even spy he.
Every time i try spy or attack he, the follow message apear:

This planet does not exist: [5:204:9].
Or you have set more ships than you have.
You can not attack this player. He has declared an immunity versus you, which will expire 72 hours after activation.
Missunderstanding about the resources (maybe not enough gas for the fleet?)

The planet exist, i have ships, the player isnt immunity mode and i have gas. So why i cant attack he ?

Help me please.

He has an immunity, you can see at galaxy when it was activated.

Every player can use 5 protection modes per game round. May be he activated 2 in a row? Or more ...
